Employment Law

Employment discrimination lawsuits may be pursued under the California Fair Employment and Housing Act (FEHA) or a federal anti-discrimination law, such as Title VII of the Civil Rights Act of 1964, the Americans with Disabilities Act (ADA), or the Age Discrimination in Employment Act (ADEA). In most situations, FEHA provides the greatest protection for employees, but each case is unique.

Under FEHA, your employer should not discriminate against you based on protected characteristics, such as race, color, sex, gender identity, sexual orientation, religion, national origin, ancestry, physical or mental disability, medical condition, and more. Discrimination can include any adverse employment action, such as termination, failure to hire, demotion, disparity in pay, or failure to promote. FEHA applies to employers with at least five employees, whereas Title VII and the ADA apply to employers with at least 15 employees. Personal Injury

Personal InjuryIf you were injured in an accident caused by someone else, you may be able to recover damages by bringing a personal injury lawsuit. Many personal injury lawsuits are pursued under a theory of negligence. To establish negligence, you will need to prove that it is more likely than not that the defendant owed you a duty of care, the defendant failed to use the appropriate care, this caused your accident, and you incurred damages.

The duty owed by a defendant depends on the circumstances. For example, all drivers owe a duty to use reasonable care given the road conditions. This means that they should not engage in careless, reckless, or aggressive behaviors, such as distracted driving, excessive speeding, or tailgating. Meanwhile, a property owner owes visitors a duty to keep the property reasonably safe and to provide warnings or repair dangerous conditions. If you are injured in a retail store or grocery store due to a dangerous condition, you may be able to bring a premises liability lawsuit against that entity.

Immigration

Immigration LawIt can be difficult to navigate the immigration system on your own. Deportation proceedings, also known as removal proceedings, are proceedings to remove a foreign national from the U.S. that are pursued under Immigration and Nationality Act section 237. If you wish to stay in the country, you will need to explore all the possible options. You may be able to show that you are eligible for cancellation of removal, for example, or you may be able to file for withholding of removal or protection under the Convention Against Torture. If you are outside the U.S. and hoping to live here, on the other hand, you will need to file an immigrant petition. While some immigrants can apply on their own because they are investors or have extraordinary talents, most immigrants must file a family-based or employment-based petition. Foreign nationals who are not planning to stay in the U.S. permanently can file a non-immigrant petition.

Business Litigation

Business LitigationComplex disputes may arise between businesses or between people who are involved in running a business. Many disputes involve contracts or an alleged breach of a fiduciary duty. Contracts are enforceable agreements in which the parties agree to perform certain acts in exchange for something of value. If either of the parties fails to perform under the contract, and the other party is harmed, they may file a lawsuit for breach of contract. Fiduciary duties arise from certain relationships that involve a special level of trust. If a fiduciary breaches their duties, and you suffer losses as a result, you can bring a claim to pursue those damages.
